On July 11, 2018, the Ministry of Ecology and Environment issued the Law on the Prevention and Control of Environmental Pollution by Solid Wastes (Revised Draft) (Draft for Comment). The law of the Ministry has been revised five times. This revision is the most extensive and is expected to be officially introduced in mid-2019.


Source reduction and resource utilization are a major trend in environmental governance. This revision clearly proposes the establishment of a solid waste discharge permit, solid waste is included in the discharge permit management, emphasizing the main responsibility of the waste generator, and is not transferred with the solid waste transfer. “The solid waste producers bear solid waste according to law. Responsibility for waste pollution and environmental protection." The law of the Ministry is both a new variable and an opportunity for the development of the solid waste industry.


Solid waste is worth looking forward to


Solid waste treatment is becoming one of the fastest growing industries in China's environmental protection industry.

Early solid waste is more about expanding the market around waste incineration. The real solid waste chain is very long. The waste incineration link is the first to be seized. Because in the government-led environmental protection industry, domestic waste incineration is the most urgent.


The solid wastes such as household garbage, kitchen utensils, construction waste, animal and poultry, hazardous waste, and resource utilization are supervised by the five departments of housing construction, urban management, agriculture, commerce, and environmental protection, respectively, and are in the state of separate management of Wulong Water Control. However, the current trend in the solid waste market is changing, and a systematic trend is taking shape. Taking Henan Province as an example, the province started the unified planning of the province earlier, and the amount of garbage above 600 tons was landed in the vein industrial park. On October 19, 2018, the four departments of the National Development and Reform, Land, Environmental Protection, and Housing and Construction approved the overall plan for 19 industrial parks.

In addition to the extension of the producer responsibility system and the garbage classification system, the revised draft also revised the specific penalties. The fines for various illegal activities were raised to 1 million yuan, and the environmental violation costs of sanitary enterprises were further increased.

The current "Solid Waste Law" has been implemented since 1996. The first major revision was made in 2004, and this time it was the second major revision of the "Solid Waste Law" in 22 years. It is understood that the revised draft of the "Solid Waste Law" consists of six chapters and 102 articles, of which 50 are amended (excluding the clauses that only modify "environmental protection" as the "ecological environment"), 14 new articles are added, and four articles are deleted.

 

The revised draft reinforces the main responsibility of producers, emphasizing that solid waste generators are the primary responsible for solid waste management. The draft also proposes a “producer responsibility extension system” to absorb and solidify the management experience of waste electrical and electronic products, encourage producers to carry out ecological design, establish a recycling system, and promote resource recycling.

 

It is worth mentioning that the revised draft has amended the penalties for some illegal acts, and the fines for a number of illegal acts have been raised to 1 million yuan. Some behaviors without specific penalties have also been added to the corresponding penalties.
